About Warranty
Acer Japan (hereafter “Acer”) provides, for air purifiers and circulators purchased as Japan domestic models from authorized retailers, a two-year warranty from the date of purchase, and for hair dryers a one-year warranty from the date of purchase, consisting of fault determination and support via the customer center.
Transfer, resale, and used products are not covered by these Warranty Terms (hereafter “these Terms”). These Terms promise support for the stated period and under the stated conditions; the scope of support is to determine whether the product is normal or to restore it to normal operating condition. They do not guarantee the achievement of any particular purpose: a product is deemed normal when it operates correctly while connected to Acer’s verification equipment. Acer accepts no liability for the effect on other connected devices resulting from the use of this product.
Acer may change the support method without notice. These Terms do not limit the customer’s statutory rights.
During the warranty period, if a natural fault is confirmed, Acer will, at its discretion, either (1) diagnose the fault and, if judged a natural fault, repair or replace it, or (2) refund the amount paid less depreciation at the time of return. Acer may require the customer’s cooperation when diagnosing the problem. The customer must agree to Acer’s warranty procedure. If the customer cannot cooperate or does not agree to the procedure, Acer is released from its warranty obligation.
Repairs performed by anyone other than Acer or an Acer-designated repair center are not covered by these Terms.
Parts used for replacement will be new, or factory-reconditioned parts equivalent in function and performance to new. Ownership of replaced faulty parts transfers to Acer and they will not be returned. The warranty period after repair is the remaining original warranty period, or 90 days from shipment of the replaced part (whichever is longer). Except in cases of intent or gross negligence, Acer is not liable for any damages (including but not limited to damages based on reduced business profit, damages based on business interruption, and other monetary damages). If Acer is liable for damages, the upper limit is the price the customer actually paid for this product. If Acer requests return of the faulty part or product, the customer must return it within 7 days of receiving the replacement; otherwise Acer may charge for the replacement part or product.
This warranty does not apply in the following cases, and repair may be refused even within the warranty period. Accepted repairs will be charged.
This warranty does not cover misuse or minor defects within design specifications that do not substantially impair functionality.
Acer is not liable for damage caused by unauthorized service or parts, or combination with third-party products.
The conditions of the service Acer provides to the customer consist of this warranty document and any additional terms stated in the individual service descriptions Acer provides. For support within the warranty period, contact the customer center with: customer name, phone number, proof of purchase (warranty or receipt showing purchase date), product model number, serial number, and specific fault details. For support outside the warranty period, prepaid charged support is required; see our website for details.
Except for the warranties expressly stated in this document and warranties that applicable law deems impossible to exclude, restrict or modify, Acer disclaims all express or implied warranties. The terms of any implied warranty that cannot be disclaimed are limited to the scope of the terms of this agreement, and the limit of the mutual liability of Acer and the customer is the amount the customer paid for the product or service plus interest prescribed by law. The customer and Acer are not liable to each other for anything that could not be performed due to events beyond their control. Events beyond control include natural disasters, accidents to property and persons, loss of use, business interruption, loss of profit, loss of data, and other indirect, punitive or special damages, regardless of whether the cause is breach of warranty or contract, tort (including negligence) or strict liability, other than damages that applicable law does not allow to be restricted, excluded or regulated. This warranty document gives the customer certain legal rights; the customer may also have other rights that vary by jurisdiction. Some jurisdictions do not allow continued implied warranties or the exclusion or limitation of incidental or consequential damages, in which case the limitations or exclusions above do not apply to the customer.
The customer and Acer agree that the Tokyo District Court shall have exclusive jurisdiction over any dispute arising between the customer and Acer.
The customer may not transfer this warranty document without Acer’s written consent. Acer and its subsidiaries and affiliates are beneficiaries under this warranty document. If there is a conflict between this warranty document and any other contract enclosed with or related to a product or service purchased from Acer, this warranty document prevails. This warranty document may not be modified, altered or corrected without Acer’s written consent. Unless Acer expressly agrees in writing, any additional or altered terms are legally void. If any provision of this warranty document is illegal or unenforceable, the legality and enforceability of the remaining provisions are not affected or impaired. This warranty document is construed under the laws of Japan, except for provisions on conflicts of law. The provisions of this warranty document comply with the applicable provisions of Japanese consumer protection law, and that application cannot be limited by any individual contract.
